§ 1 Scope of application
The business relationship between CMV Hagedorn (hereinafter referred to as "CMV") and the customer shall be governed exclusively by the following General Terms and Conditions (hereinafter referred to as "GTC") in the version valid at the time of the order.

These GTC only apply to consumers. Consumers are natural persons who place their order for a purpose that is not attributable to the commercial or independent professional activity of the customer.

These terms and conditions do not apply to book tables and dealers. We will be happy to send you the conditions applicable in this case on request.

§ 2 Conclusion of contract
Online orders: Contracts can only be concluded on this portal (www.cmv-duesseldorf.de) in German. By sending the order to CMV, you confirm that you have unlimited legal capacity. You submit a binding offer when you go through the online ordering process by entering the information requested there and click on the "Buy now" button in step 3.
If you have placed your order via our online shop www.cmv-duesseldorf.de, we will send you an e-mail confirming receipt of your order and listing its details (confirmation of receipt).

This confirmation of receipt does not constitute acceptance of your offer, but merely informs you that we have received your order.

The purchase contract is concluded when we accept the contractual offer contained in your order. Acceptance takes place either by express written declaration or by receipt of the goods by the recipient.

The contract is concluded with CMV Hagedorn, unless expressly stated otherwise. Your order data will be stored in our system. We will send them to you on request.

§ 3 Reservation of non-availability
We reserve the right to refrain from fulfilling an order if we do not have the ordered goods in stock and they are also not available from the publisher or supplier. In this case, we will inform you immediately of the unavailability and refund any purchase price already paid without delay.

New publications that are not yet available and titles in an order that are specified in our advertising with a publication date will be earmarked and delivered later if they are available. This subsequent delivery is free of postage if this delivery requires additional despatch to the first delivery of the order.

§ 4 Cancellation and consequences of cancellation
Consumers have a right of cancellation in accordance with the following conditions:

You have the right to cancel this contract within fourteen days without giving any reason. The cancellation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the goods.

You can use the attached sample cancellation form, but this is not mandatory. To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right of cancellation before the cancellation period has expired.


Consequences of cancellation
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this repayment. We may withhold the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earliest.

You must return or hand over the goods to CMV Hagedorn, Georg Hagedorn, Im Huferfeld 10, 40468 Düsseldorf immediately and in any case within fourteen days at the latest from the day on which you inform us of the cancellation of this contract. You shall bear the direct costs of returning the goods and shall only be liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

The right of cancellation does not apply to the following contracts:

1. contracts for the supply of goods which are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer,
2. contracts for the delivery of goods that can spoil quickly or whose expiry date would be quickly exceeded,
3. contracts for the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery,
4. contracts for the supply of sound or video recordings or computer software in a sealed package if the seal has been removed after delivery,
5. contracts for the delivery of newspapers, periodicals or magazines with the exception of subscription contracts.

§ 5 Prices and shipping costs
Our prices are final prices in euros. They include statutory VAT and do not include shipping costs. The price at the time of ordering applies.

The shipping costs are based on the current DHL prices and are graded according to weight. Under certain circumstances, the shipping costs may change between placing the order and dispatch of the goods. The shipping costs listed on the invoice enclosed with the goods are decisive.

If, for technical or logistical reasons, the goods are dispatched in several stages, we will of course only charge the shipping costs once.

For shipments abroad, the actual shipping costs incurred will be invoiced, which can be seen after entering the address in the shopping basket. The specific import and customs conditions must be observed and fulfilled by the customer.

§ 6 Terms of delivery and payment
Payments are made by bank transfer (by invoice).

Delivery takes place within 3-5 working days after conclusion of the contract.

Should you fall into arrears with your payments, we reserve the right to charge you reminder fees.

§ 7 Liability for defects
If there is a defect in the purchased item, the statutory warranty provisions of §§ 434 ff. BGB APPLY.

§ 8 Retention of title
The goods remain our property in accordance with § 449 BGB until full payment has been made. The buyer is obliged to inform the seller immediately of any seizure by third parties of the goods delivered subject to retention of title and to send the documents justifying the seizure. The buyer undertakes to send the seller a copy of the seizure protocol without delay.

§ 9 Terms of use for downloads
CMV Hagedorn does not grant the customer ownership of e-books, sheet music (pdf) and audio files. The customer acquires a simple, non-transferable right, revocable before full payment of the licence fee, to use the title offered for personal use.

The content of an e-book and/or an audio file may not be changed by the customer in terms of content or editing, subject to deviating mandatory legal regulations.

It is not permitted to pass on e-books, PDF or MP3 audio files to third parties; moreover, passing them on is not permitted, nor is making them publicly accessible or forwarding them, placing them on the Internet or in other network media for a fee or free of charge, reselling them and/or using them in any other way for commercial purposes.

E-books and MP3 files may be saved on your own PC or MP3 player and burnt to CD for your own private use. They may not be passed on to third parties, made available (e.g. on the Internet), rented, broadcast or performed in public.

Sheet music files only authorise the production of printouts or copies in the amount of the order quantity specified and listed on the printout. Further copies must be licensed separately.

The download of a song text file / sheet music is not associated with a licence for projection (public reproduction within the meaning of § 52 UrhG). The use of the lyrics / sheet music by means of an overhead projector or video projector, e.g. in the community, requires a separate licence.
Any use of the downloaded files that goes beyond the aforementioned authorisation of use constitutes a copyright infringement under applicable law and is punishable by law.
CMV accepts no liability for the compatibility of the downloaded music files with mobile MP3 players or for their burnability on CD.

§ 10 Severability clause
Should a provision be or become invalid, the remaining provisions shall remain valid.
